Medical Marijuana

Passed in 1996, Proposition 215 (the “Compassionate Use Act”) made the medical use of marijuana legal in California. In 2003, Senate Bill 420 was passed as a clarification of Proposition 215 and required the establishment of a statewide medical marijuana identification card and registry program under California Health and Safety Code and California Code of Regulations.

The San Joaquin County Board of Supervisors approved implementation of the Medical Marijuana Identification Card (MMIC) Program in late 2008, and the County's MMIC Program opened in early 2009.

Under this State-wide and State-mandated program, San Joaquin County Public Health Services Vital Records Office is responsible for processing MMIC applications and issuing identification cards to qualified patients and primary caregivers who are residents of the County.

Patients with qualified medical conditions have their doctor's recommendation to use marijuana for medical purposes. A legal representative or a primary caregiver may apply for the qualified patient.

Participation in the Medical Marijuana Identification Card (MMIC) Program is voluntary.

The MMIC Application/Renewal form (CDPH 9042) and Physician’s Documentation (CDPH 9044) can be obtained below or at the Vital Records Office in the Public Health Services building in Stockton.

It’s highly recommended to follow the checklist to ensure you have everything.

Applicants must submit required documentation, have a digital photograph taken, and pay fees at the time of the appointment. The fee for the card is $20.00 for MediCal recipients and $40.00 for all others.

Completed applications will be accepted by in-person appointments only.

Appointments may be scheduled by calling the Public Health Services at (209) 468-3401, Monday through Friday between the hours of 8:00 am and 5:00 pm.

You must bring the following items with you or your application will be rejected:

  • MMIC Application/Renewal form (CDPH 9042).  Please make sure you read the application carefully and complete all necessary sections.
    • For applicants with a caregiver, the caregiver section must also be completed.
  • Physician’s Documentation form (CDPH 9044) recommending the use of medical marijuana as appropriate for one or more serious medical condition.
    • Must have original (wet/ink) signature. No fax, scan, e-mail copies will be accepted.
    • Include your physician’s name, contact information, and California medical license number.
  • Proof of identity. This can be a valid California Department of Motor Vehicles (DMV) driver's license or identification (ID) card, or another valid government-issued photo card.
    • For applicants with a caregiver, the caregiver must present their ID as well.
  • Proof of residency. This can be a current and valid DMV motor vehicle registration, current rental or mortgage agreement, or utility bill. This proof must have patient's name bearing current physical address.
  • Fees. Non-refundable application fee of $40.00 (or $20.00 for Medi-Cal beneficiaries).
    • Cash, Money Order, debit card, credit card accepted (no personal checks).
  • Medi-Cal Card (if applicable)

When applying, both the primary caregiver, if any, and the qualified patient must be present. If the patient is under the age of 18 years old, their parent must also be present.

You will not get your ID card the same day as the appointment.  It will be delivered to San Joaquin County Public Health Services, Vital Records Office, and we will call you when it arrives at our office. Turnaround varies; usually 1-2 weeks. The ID card will need to be picked up.

Cards are valid for one year from date of issue and you will need to renew each year following the same process.
